Apna Records Terms of Service

Draft — pending legal review

These terms of service are a draft. A lawyer has not reviewed them yet, and they are not in force.

Text in square brackets, such as [Counsel: …] notes, is still to be completed by the lawyer before publication.

Effective date: [Effective date]

1. These terms

These terms are an agreement between you and Amit Kumar (Apna Records), Amrit Dairy, Sonipat, Haryana, India ("we", "us"). They apply to the Apna Records Android app, the website at https://app.apnarecords.amitsheoran.com and the service behind them. By creating an account or using the service you accept these terms. Our Privacy Policy, at https://app.apnarecords.amitsheoran.com/privacy, explains how we handle personal data.

2. Who may use Apna Records

  • You must be 18 years or older.
  • If you open a business workspace, you confirm that you may act for that business.
  • One account belongs to one person. Do not share your sign-in or your master passphrase.

3. What Apna Records is, and what it is not

Apna Records is a private organiser for documents and details. Your records are encrypted on your phone before they are uploaded.

  • Not a government service. Apna Records is independent. It is not affiliated with, approved by or connected to any government body or government service.
  • No verification. Apna Records does not verify, authenticate or certify any document or identity. Features that the app shows as "not set up" are not available.
  • Check suggestions. The app reads text and suggests document types, people and dates. These suggestions can be wrong. You are responsible for checking them.
  • Reminders are a help, not a guarantee. Reminders are scheduled on your phone. They can arrive late or not at all, for example if notifications are switched off or the phone limits background work. Do not rely on them alone for deadlines.
  • Checklists are suggestions. A checklist does not say which documents the law requires you to have.
  • Copies are not originals. A stored or scanned copy does not replace an original document. Keep your originals.
  • No advice. Nothing in the service is legal, tax or financial advice.

4. Your account, passphrase and recovery kit

  • You sign in with a code sent to your e-mail address. Keep your e-mail account secure.
  • Your master passphrase and your recovery kit open your vault. We never see them and cannot reset them.
  • If you lose your passphrase, your recovery kit and every trusted phone, your encrypted records cannot be opened by anyone, including us. We can restore access to your account, but not to its encrypted contents.
  • Use a screen lock on your phone. Tell us at once at asheoran007@gmail.com if you think someone else has used your account.

5. Your content

  • You keep all rights in the documents and information you store ("your content").
  • You allow us to store, copy (including in backups) and transmit your content in encrypted form, only to provide the service to you and the people you share with.
  • You confirm that you have the right to store the documents you add, including documents about family members, employees or other people, and that you have their permission where the law requires it.
  • The secure section has no fields for card CVV or PIN. Do not store CVVs, PINs or one-time passwords anywhere in the service.

6. Acceptable use

You must not use Apna Records to:

  • store or share content that is unlawful, or that you have no right to hold;
  • harm, deceive, impersonate or harass anyone;
  • upload malware or try to break, overload or get around the security or limits of the service;
  • try to reach data or accounts that are not yours;
  • copy or resell the service.

7. Workspaces and members

  • A workspace has an owner and may have admins and members. The owner is responsible for who is invited and what each person can open.
  • Owners and admins can see the e-mail addresses of their workspace members.
  • When a member is removed, the owner should rotate the vault key when the app asks, so that the removed person cannot open new records.
  • If an owner deletes a workspace, it is deleted for every member. Records a member added to a shared vault belong to that workspace.

8. Sharing

You decide what to share. Files sent through Android's share sheet go to the app you choose. A share link can be opened by anyone who has the full link until it expires (at most 30 days), is revoked or reaches its view limit. People who receive a file may keep a copy; we cannot recall it.

9. Plans, trial and payments

  • Paid plans (Essential, Family Plus and Business Pro, monthly or yearly) are subscriptions sold through Google Play. Google Play's terms apply to the payment. The price, including any taxes, is shown by Google Play before you buy.
  • Subscriptions renew automatically until you cancel. You can cancel at any time in Google Play (in the app: More → Plan and billing → Manage subscription in Google Play). Your plan stays active until the end of the period you paid for.
  • Refunds follow Google Play's refund policies. [Counsel: any additional refund terms required by law.]
  • A new account gets one 14-day trial with 500 MB of storage for its first workspace. The trial is free, needs no payment details and does not renew.
  • Each plan has limits, such as storage, members and profiles, shown in the app. When a plan or the trial ends, or you go over a limit, new uploads pause. You can still open, export and delete your records. We do not delete records because a plan ended.
  • If we change prices, we will follow Google Play's process for price changes and tell you in advance.
  • Deleting your account, or a workspace you own, stops the renewal of Google Play subscriptions for the deleted workspaces.

10. Services from other companies

Apna Records relies on Google Play (purchases), Google Play services and ML Kit (scanner and on-phone text reading), our hosting and storage providers, and our e-mail provider. Their own terms may also apply to you.

11. Availability and changes

We work to keep Apna Records available and to keep encrypted backups of our systems. We cannot promise that the service will always be available or free of errors. Our backups exist to restore our service, not as a personal backup for you: keep your own originals. We may change or remove features; we will tell you in advance about important changes.

12. Export and deletion

You can download an encrypted export of your records and delete documents, workspaces or your whole account at any time, in the app or on the web. You open an export on your own device with your master passphrase or recovery key, in a web browser at https://app.apnarecords.amitsheoran.com/open-export or with the apna-open-export command-line tool. Account deletion takes effect after a 7-day grace period in which you can cancel. Some records are kept after deletion as described in the Privacy Policy.

13. Suspension and termination

We may suspend or close an account that breaks these terms, that the law requires us to act on, or that puts other users or the service at risk. Where the law and safety allow, we will tell you first and give you a chance to export your records. [Counsel: notice periods and appeal.]

You may stop using Apna Records and delete your account at any time.

14. Intellectual property

The app, the website and the Apna Records name and logo belong to Amit Kumar (Apna Records) or its licensors. Open-source components are used under their own licences, listed in the app under More → About → Open-source licences.

15. Disclaimers and limits of liability

[Counsel: disclaimer of warranties, limitation of liability, exclusions that the law does not allow, and indemnity.]

16. Law and disputes

These terms are governed by the laws of India. [Counsel: courts of [City] / arbitration.] Nothing in these terms takes away rights you have under consumer protection law.

17. Grievances

Grievance Officer: Amit Kumar, Proprietor, asheoran007@gmail.com, Amrit Dairy, Sonipat, Haryana, India. [Counsel: acknowledgement and resolution times.]

18. Changes to these terms

We will post changes with a new effective date and tell you in the app or by e-mail before important changes take effect. If you keep using Apna Records after that, the new terms apply.

19. Contact

Amit Kumar (Apna Records), Amrit Dairy, Sonipat, Haryana, India, asheoran007@gmail.com.
